ShiftKeys Inc ("ShiftKeys", "we", "us") respects your privacy. This Privacy Policy describes what information we collect through our website and the ShiftKeys app (the "Service"), how we use it, with whom we share it, and your rights. This policy is part of our Terms of Service and Acceptable Use Policy.
Information We Collect
- Account Information: When you sign up or subscribe, Stripe provides us with certain account details (like your email, name, and subscription status). We collect this for identity verification, paid tier subscription management, and billing.
- User-Provided API Keys: If you choose to use your own AI API keys, we may temporarily collect them to route your queries, but we do not use them beyond providing the Service.
- Usage Data and Metadata: Whenever you use the app to send a query, we centrally collect and store technical metadata about that request, but not the contents of your query. Metadata includes information such as user unique ID, app version, app mode, timestamp, program in context when the request is initiated, and various request performance metrics (e.g., model used, request success or failure status, the number of tokens in your prompt, latency, etc.). This data helps us troubleshoot issues, analyze performance, and improve the product.
- Cookies and Tracking: On our website (www.shiftkeys.ai), we use cookies and similar tracking technologies. This may include third-party analytics tools to track page views, referrals, and aggregate user behavior. Cookies help us understand how visitors use the site and improve it. You can usually disable cookies via your browser settings, though doing so may affect some site features.
How We Use Your Information
- To Provide the Service: We use your account and subscription information to authenticate you via Stripe and to ensure you have access to the features you paid for. We use your inputs into the ShiftKeys app to send queries to AI providers and return results.
- For Analytics and Improvement: Usage metadata (tokens, timestamps, etc.) helps us monitor the health of the Service, analyze trends, and optimize performance. We use cookies/analytics on the website to understand how users engage with our site and to improve marketing and content.
- To Communicate: We may use your email to send account notices, updates, newsletters, or other information related to the Service. You can opt out of promotional emails by following the unsubscribe instructions.
- For Legal and Safety: We may use data to comply with laws or regulations (for example, to respond to lawful requests or protect against fraud). We also use data to detect and prevent abuse.
Sharing and Disclosure
- Third-Party Service Providers: We work with service providers to deliver the Service. For example, we share data with:
- Stripe: For payment processing and paid tier account verification, Stripe receives your payment data and any personal information you provide in their OAuth flow.
- AI Providers: Your prompts (and any associated metadata like tokens or timestamps) are shared with third-party AI APIs (e.g., OpenAI, Anthropic, Google, xAI, etc.) to generate outputs. These providers may log or store your inputs/outputs according to their own policies. Each provider has its own data handling rules. We do not control those policies. If a provider's data practices are a concern, you may choose to supply your own API key or not use that provider.
- Analytics Services: We may share de-identified usage analytics with third-party analytics companies to help us improve our Service.
- Legal Requirements: We may disclose your information if required by law, such as to comply with a subpoena, law enforcement request, or similar legal process.
- Business Transfers: If ShiftKeys is involved in a merger, acquisition, or sale of assets, user data may be transferred as part of that transaction.
We do not sell your personal information. We only share data as described above, for the purposes outlined.
Data Retention and Security
We retain your personal data only as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Usage metadata may be stored for several years to allow us to analyze trends and usage. We implement reasonable technical and organizational measures to protect your data (e.g., encryption in transit, access controls). No system is completely secure, but we take steps to safeguard your information. In case of a data breach affecting your data, we will notify affected users and authorities as required by law.

Acceptable Use Policy (AUP)

This Acceptable Use Policy describes prohibited uses of the ShiftKeys app and related services (the "Service"), including all features, content, and functionality (collectively, the "Software"). By using the Service, you agree not to engage in any prohibited activities. Violation of this AUP may result in suspension or termination of your account.
Prohibited Content and Activities
You may not use the Service to engage in any of the following:
- Illegal or Dangerous Activities: Any content or instructions that facilitate illegal activities, criminal wrongdoing, or violence. This includes advice or tips for committing crimes, synthesizing illicit substances, hacking, or other unlawful actions.
- Harmful or Abusive Content: Content that promotes terrorism, violent extremism, or self-harm. This includes graphic violence, instructions to self-harm, or encouragement of suicide.
- Child Sexual Abuse: Any content that depicts or encourages sexual activities with minors is strictly prohibited.
- Hate Speech and Harassment: Content that harasses, threatens, or incites violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics. This includes slurs, degrading remarks, or encouraging others to harass or dox an individual.
- Sexually Explicit Content: Adult sexual content (pornography, erotic sexual content) or fetish content is prohibited. This includes pornographic text or instructions for sexual activities.
- Misinformation and Fraud: Content intended to mislead or defraud others. This includes impersonation of individuals to deceive others, conspiracy theories presented as factual, or scams (fraudulent schemes, phishing, etc.). You may not use the Service to impersonate public figures or make misleading claims in critical areas (such as health or legal advice).
- Privacy Violations: You may not generate or share content that invades others' privacy. This includes sharing personal data (like financial, medical, or identity information) without consent, or facilitating unauthorized surveillance.
- Harm to Security: Do not use the Service to develop or distribute viruses, malware, or hacking tools. Do not attempt to breach or interfere with the security of any system (including the Service itself). Actions such as denial-of-service attacks or exploiting vulnerabilities are prohibited.
- Intellectual Property Infringement: Do not use the Service to create content that infringes on copyrights, trademarks, or other intellectual property without permission. For example, do not generate outputs that you know are copyrighted or patented unless you have rights.
- High-Risk Automated Decisions: Do not use AI outputs from the Service to make significant decisions about people (such as credit approval, hiring, legal sentencing) without human review. AI output must not be used in a way that could materially affect individual rights in areas like employment, health, or legal matters.
- Violations of Third Party AI Service Provider Terms or Policies: ShiftKeys leverages various third party AI providers (e.g., OpenAI, Anthropic, Google, xAI, etc.) to provide responses to your queries. Submitted queries and subsequent use of responses to these queries must not violate any terms or policies of the third party provider(s) you select.
Other Restrictions
- No Circumvention: Do not attempt to bypass any usage limits, security measures, or the requirement to authenticate via Stripe.
- No Unauthorized Access: Do not use anyone else's account without permission. Do not share your account or API keys with others.
- No Spam: Do not use the Service to generate spam, bulk unsolicited messages, or repeated advertising.
- Compliance with Laws: You must comply with all applicable laws and regulations when using the Service.
Enforcement
ShiftKeys reserves the right to monitor usage for compliance. If we suspect a violation of this AUP, we may investigate and take appropriate action, including warning, suspension, or termination of your account without notice. We may also report illegal activities to authorities.

Terms of Service

Welcome to ShiftKeys.ai. These Terms of Service ("Terms") govern your access to and use of the ShiftKeys app and related services (the "Service"), including all features, content, and functionality (collectively, the "Software"). By using the Service, you agree to be bound by these Terms (and our Privacy Policy and Acceptable Use Policy). If you do not agree, do not use the Service.
Accounts and Subscriptions
Paid tier users must maintain an active subscription and log in via Stripe Oauth. Stripe will process all payments. Stripe will process all payments and may provide us with your account information (such as name and email). ShiftKeys does not store your payment details; Stripe securely manages billing. You are responsible for maintaining the confidentiality of your account credentials. You may have access to additional features or higher usage limits based on your subscription level. All fees are stated in USD (or as otherwise noted) and are non-refundable, except as required by law. You authorize ShiftKeys to automatically charge your payment method for renewal fees. If payment fails, we may suspend or cancel your subscription.
Use of API Keys
ShiftKeys may let you use your own API keys (e.g., for OpenAI or Anthropic) or leverage the ShiftKeys API key pool to process queries. In either case, your prompts and queries are sent to third party providers on your behalf. You remain responsible for securing your API keys and for any usage billed to your keys or to our service.
Permitted Use and Compliance with AUP
You may use the Service only in accordance with these Terms and our Acceptable Use Policy. You agree not to use the Service for any unlawful or prohibited activities (see the AUP for details). You are responsible for your own content provided in input queries ("Input") and any outputs from the AI you choose to use ("Output"). You represent that you have all necessary rights to submit your inputs, and that your use of the Service (and any Output) will not violate any laws or third-party rights (for example, privacy or intellectual property rights).
Third-Party Services
The Service relies on third-party AI providers (such as OpenAI, Anthropic, xAI, Google, etc.) to generate responses to your Input. These providers have their own policies and disclaimers. In other words, we do not control these external services or the content they produce, and we make no guarantees about their availability or performance. Any use of third-party services is at your own risk and subject to the terms of those providers.
Ownership of Content
You retain all rights to Input and Output. As with many AI services, ShiftKeys does not claim ownership of your content; rights, title, and interest in any Output produced is subject to the policies of the third party AI provider used to generate each response. You may use the Output for any lawful purpose. Input and Output are stored locally on your device to append to subsequent queries within a conversation in order to provide context, but ShiftKeys does not centrally collect or analyze this information. We do not use Input or Output to train our own models, and we will never republish your personal data, Input, or Output without your consent.
Disclaimers and No Warranties
The Service and any Output are provided "as-is." We make no warranty that the Service will be uninterrupted, error-free, or secure, and we explicitly disclaim all warranties, express or implied, regarding the Service and its Output. ShiftKeys does not guarantee the accuracy or reliability of any Output. This content is subject to the policies of third party providers. In particular, AI-generated content may not always be accurate. You should evaluate and verify the Output before using or sharing it. We expressly advise you not to use AI output as a substitute for professional advice (legal, medical, financial, etc.). We will not be liable for any losses or damages arising from your reliance on AI-generated content.
Limitation of Liability
To the fullest extent permitted by law, ShiftKeys and its affiliates are not liable for any indirect, incidental, special, consequential or punitive damages of any kind arising out of or relating to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim related to the Service will not exceed the total fees you paid us in the three months preceding the claim.
Modifications to Terms and Service
We may modify these Terms at any time. We will notify you of any material changes (for example, via email or a notice in the app). Your continued use of the Service after notice constitutes acceptance of the new Terms. We may also update, suspend, or discontinue the Service (or any feature) without liability.
Termination
We may suspend or terminate your access to the Service at any time for any reason, including if you breach these Terms or the Acceptable Use Policy. Upon termination, you must stop using the Service. Sections like Disclaimers and No Warranties, Limitation of Liability, and Governing Law and Dispute Resolution will survive termination.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware (USA) and applicable U.S. federal law, without regard to conflict of laws principles. Any dispute will be resolved by binding arbitration under the rules of the American Arbitration Association, and each party waives any right to participate in class or representative actions. You agree that any arbitration will take place in Delaware (or remotely, if agreed). This arbitration provision survives termination of these Terms.
